To enter the “100 Days of STIHL” Sweepstakes (the “Sweepstakes”), you must agree to abide by these Official Rules. The Sweepstakes is intended for legal residents of the United States of America (“USA”), excluding New York, only and shall only be construed and evaluated according to USA law and applicable state law. Do not enter this Sweepstakes if you are not a USA resident or are otherwise ineligible to enter in accordance with these Official Rules at the time of Entry.
1. SPONSOR
The Sweepstakes is sponsored by STIHL Incorporated, 536 Viking Drive, Virginia Beach, Virginia 23452 (the “Sponsor”).
2. ADMINISTRATORS
The Sweepstakes is administered by Bazaarvoice, 10901 Stonelake Blvd, Austin, TX 78759, AND, ViralSweep, LLC, 115 Huntington Ave. 15th Floor, Boston, MA 02199 (the “Administrators”).
3. ELIGIBILITY AND PARTICIPATION REQUIREMENTS
The Sweepstakes is only open to individuals who: (a) are legal residents of the forty-nine (49) United States (excluding New York) and Washington, D.C., which, for clarification, specifically excludes Puerto Rico and U.S. territories and possessions; (b) are at least eighteen (18) years of age or the age of majority, whichever is older, in their state of permanent residence (which is nineteen (19) in Alabama and Nebraska; twenty-one (21) in Mississippi; and eighteen (18) in all other states) at the time of Entry; and (c) have internet access and an active email account (each, an “Entrant” or collectively, the “Entrants”).
The Sponsor, the Administrators, and each of their respective parent companies, employees, officers, directors, subsidiaries, affiliates, distributors, sales representatives and advertising and promotional agencies, and the officers, directors, agents, and employees of each of the foregoing (all such individuals and entities collectively referred to herein as the “Released Parties”), and the immediate family members (defined as including spouse, biological, adoptive and step-parents, grandparents, siblings, children and grandchildren, and each of their respective spouses, regardless of where they reside) and household members of each (whether related or not) are NOT eligible to participate in or win this Sweepstakes.
This Sweepstakes is void in New York, Puerto Rico, U.S. territories and possessions, and where prohibited or restricted by law, rule, or regulation, and is subject to all federal, state, and local laws and regulations. Non-eligibility or non-compliance with any of these Official Rules will result in disqualification. Prior to being awarded a Prize, a Potential Winner (as defined below) may be required to provide proof of eligibility upon request.
4. AGREEMENT TO OFFICIAL RULES
By participating in this Sweepstakes, Entrants agree to unconditionally accept, comply with, and abide by these Official Rules. The decisions of the Sponsor as to the administration and operation of the Sweepstakes, the selection of the Potential Winners, and all other matters pertaining to this Sweepstakes shall be final and binding in Sponsor’s sole discretion. Winning a Prize is contingent upon fulfilling all requirements set forth herein. For the avoidance of doubt, any references in these Official Rules to Entrants shall also include the Entrants who are deemed Winners (as defined below).
5. HOW TO ENTER
No purchase or payment is required to be entered in the Sweepstakes or to win a Prize.
The Sweepstakes begins at 12:00:01 a.m. Eastern Time (“ET”) on August 3, 2026 and ends at 11:59:59 p.m. ET on November 10, 2026 (“Sweepstakes Period”). The Sponsor’s database computer is the official time-keeping device for the Sweepstakes.
Eligible Entrants may earn Entries (each an “Entry” or collectively, “Entries”) during each Entry Period (as defined below) by using either Method 1 or Method 2 below. Each completed submission will earn one (1) Entry. For purposes of these Official Rules, “Entry” means a completed submission by an Entrant through either Method 1 or Method 2 that satisfies the requirements set forth herein. Sponsor will assign each Entry to the Entry Period in which the Entry is actually received (based on Sponsor’s official time-keeping device).
The Sweepstakes Period will be divided into ten (10) entry periods (each an “Entry Period”) as follows. Each Entry Period will have a separate drawing as described in Section 6.

Method 1: Review Entry
During the Sweepstakes Period, Entrants can enter the Sweepstakes by submitting a product review through the online registration form linked from https://www.stihlusa.com (the “Review Website”). No purchase is necessary to submit a review or to enter. The registration form on the Review Website will require Entrants to provide their nickname, email address, and a written review of a STIHL product.
To be eligible, the review must: (a) be submitted during the Sweepstakes Period; (b) be the Entrant’s own original work and reflect the Entrant’s honest and genuine opinion based on actual experience with the product or service being reviewed; (c) be written in English; (d) not contain any content that is obscene, offensive, defamatory, threatening, harassing, discriminatory, or otherwise inappropriate as determined by Sponsor in its sole discretion; (e) not contain any personally identifiable information of any third party; (f) not infringe upon or violate any third party’s intellectual property rights, rights of privacy or publicity, or any other applicable rights; and (g) comply with any additional content requirements or submission guidelines presented on the Review Website. Reviews that do not meet the foregoing requirements may be rejected and will not be eligible for Entry into the Sweepstakes. Sponsor reserves the right, in its sole discretion, to reject, edit, or remove any review that Sponsor determines does not comply with these requirements or is otherwise inappropriate. By submitting a review, Entrant grants Sponsor and the Released Parties a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, sub-licensable, and transferable license to use, reproduce, display, distribute, publish, modify, adapt, translate, and create derivative works of the submitted review, in whole or in part, in any and all media now known or hereafter devised, for any purpose, including but not limited to advertising, marketing, and promotional purposes, without further compensation, notice to, or approval by Entrant. Entrant acknowledges and agrees that Sponsor is under no obligation to use or publish any review and may remove any review at any time for any reason. Entrant further acknowledges and agrees that, because the submission of a review in connection with this Sweepstakes constitutes a material connection under the Federal Trade Commission’s (“FTC”) Endorsement Guides (16 C.F.R. Part 255), any review that is published by Sponsor or by Entrant in connection with this Sweepstakes must include a clear and conspicuous disclosure of the Entrant’s participation in this Sweepstakes (e.g., “I received an entry in a sweepstakes in exchange for this review”). Entrant is solely responsible for ensuring that any review posted or shared by Entrant includes appropriate disclosures as required by applicable law. Upon Sponsor’s receipt of a fully completed and submitted registration form (including a review that meets the eligibility requirements set forth above), the Entrant will receive one (1) Entry into the Sweepstakes for the applicable Entry Period.
Method 2: Alternative Method of Entry (“AMOE”)
Alternatively, Entrants can also enter the Sweepstakes without providing a product review by visiting the online entry form at https://app.viralsweep.com/sweeps/full/19b4c3-229758?framed=1 (the “Online Form Website” and, together with the Review Website, the “Websites”), and entering their full name, email address, a valid telephone number, and date of birth. Upon Sponsor’s receipt of a fully completed and submitted AMOE entry, the Entrant will receive one (1) Entry into the Sweepstakes for the applicable Entry Period.
Entry Limitations and Conditions
There is no limit on the number of Entries an Entrant may submit per Entry Period, regardless of method of entry. Incomplete Entries are void. Entrants are not permitted to use any third-party organization to assist with the entry process in any way (as determined by the Administrator). Proof of entry information at the Websites is not considered proof of delivery to or receipt by Sponsor of an entry.
Entries made by any other individual or any entity, and/or originating at any other website or email address, including but not limited to commercial Sweepstakes subscription notification and/or entering service sites, will be declared invalid and disqualified for this Sweepstakes. The use of automated entry devices is prohibited, and no mechanically reproduced entries are allowed; all such Entries are void. Entry materials or data that have been tampered, altered, photocopied, or mechanically reproduced or from unauthorized channels are not eligible and will be void.
Entries must be manual key-stroked by the Entrant. The use of any automated, mechanically produced, forged, robotic, repetitive, programmed, software-generated, or similar Entry method or program will result in disqualification.
All Entries become the exclusive property of the Sponsor and will not be acknowledged or returned. All information submitted by Entrants will be treated according to Sponsor’s Privacy Policy, available at https://www.stihlusa.com/about-stihl/corporate/legal/privacy-policy/. By participating in the Sweepstakes and providing any personal contact information, Entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s Privacy Policy.
At the time of Entry, Entrants will be given the option to opt in to receive emails from Sponsor about this Sweepstakes and other promotions and information about Sponsor and its products and services. Opting in or opting out of receiving such emails will have no effect on an Entrant’s eligibility to participate in or win the Sweepstakes. All emails from the Sponsor will contain an unsubscribe/opt-out option, and Entrants may unsubscribe at any time without affecting their Sweepstakes Entry or eligibility.
Notwithstanding any opt-in or opt-out election, Sponsor (and or its designees, representatives, or agencies on behalf of Sponsor) may send Entrants transactional or relationship communications related to the administration of the Sweepstakes (e.g., Entry confirmations, Notifications, and requests for Prize Claim Documents). Sponsor will honor opt-out requests in accordance with applicable law.
For purposes of these Official Rules, a calendar “day” is defined as any twenty-four (24) hour period beginning at 12:00 a.m. ET and ending twenty-four (24) hours later at 11:59 p.m. ET, unless specified otherwise. A “business day” is defined as any day other than a Saturday, Sunday, or a U.S. federal legal holiday. All Entries that are received after the end of the applicable Entry Period will not be included in the drawing for that Entry Period.
6. DRAWINGS, NOTIFICATION, AND ODDS
Selection of Winners
The potential prize Winner(s) (each, a “Potential Winner”) will be selected in ten (10) random drawings (one drawing per Entry Period) conducted by the Sponsor and/or Administrator, whose decisions are final and binding. Each drawing will be conducted from among all eligible Entries received during the applicable Entry Period, and the number of Potential Winners to be selected (and the Prize(s) to be awarded) will be as set forth in Section 7. Each Prize drawing will be conducted on or about the 5th day following the conclusion of each Entry Period. Each Potential Winner is subject to verification of eligibility and compliance with these Official Rules. Upon Sponsor’s verification and receipt of all required Prize Claim Documents (as defined below), a Potential Winner will be deemed a “Winner.” Entries do not carry over into subsequent Entry Periods.
Odds
Odds of winning a Prize will depend on the total number of eligible Entries received during the applicable Entry Period.
Winner Notification
The Potential Winners will each be contacted by the Sponsor and/or its designee or representative via email at the email address provided on their Entry form within 5 business days from the time the Potential Winner is selected (the “Notification”). Notification is deemed to have occurred immediately upon the sending of the email by Sponsor to the Potential Winner. The Potential Winner must respond within 3 business days with his/her contact information needed for verification purposes.
If a Potential Winner does not respond to the Notification within 3 business days, at Sponsor’s sole discretion, an alternate Potential Winner may be selected by Sponsor at random from among all remaining eligible Entries received for the applicable Entry Period.
Sponsor is not responsible for changes to an Entrant’s email address or contact information that may interfere with Notification, including but not limited to suspended or discontinued Internet service, spam or junk-mail filtering, or any other reason which may result in a Potential Winner not receiving the Notification. Sponsor shall have no liability for any Notification that is lost, damaged, delayed, garbled, illegible, incomplete, misdirected, undelivered, intercepted, or otherwise not received by a Potential Winner for any reason.
In the event of a dispute regarding the identity of the person submitting the Entry, the “Authorized Account Holder” of the email address used to enter this Sweepstakes (at the time of Entry) will be deemed to be the Entrant. For purposes of these Official Rules, the “Authorized Account Holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. In the event such a dispute regarding the identity of the person who actually completed and submitted the Entry cannot be resolved to Sponsor’s satisfaction, the affected Entry will be deemed ineligible.
After Sponsor receives the fully and accurately completed and properly executed Prize Claim Documents (if required) and Sponsor has verified eligibility, such Potential Winner will be deemed a “Winner,” and Sponsor will arrange to deliver the Prize to the Winner. The Winner should allow 6 to 8 weeks from Notification for delivery of the Prize. The Prize will be delivered by Sponsor at no cost to the Winner. The Prize is awarded subject to verification of eligibility and compliance with these Official Rules.
7. PRIZES AND APPROXIMATE RETAIL VALUE (“ARV”)
There will be ten (10) prizes awarded (each a “Prize” and collectively, “Prizes”). The Prizes, the number of Winners to be selected for each Prize, and the applicable Entry Period(s) (or drawing(s)) are set forth below (the “Prize Schedule”). Each Potential Winner selected in a drawing will be awarded the Prize (or one of the Prizes) designated for that drawing in the Prize Schedule.
Prize: Official STIHL Product Certificate. ARV: $1,000.00 each. Number of Winners: Ten (10) (one (1) per Entry Period). Applicable Entry Period/Drawing: One (1) Winner will be selected per Entry Period as set forth in Section 6.
The total ARV of all Prizes to be awarded is $10,000.00.
Entrants may win one (1) Prize per Entry Period, and there is no limit on the total number of Entry Periods an Entrant may win during the Sweepstakes Period. The Prize(s) cannot be re-sold, transferred, substituted, assigned, or redeemed for cash except at Sponsor’s sole discretion. The Official STIHL Product Certificate must be redeemed in store at a participating STIHL dealer. Sponsor reserves the right to substitute a Prize, or a portion thereof, with a prize of comparable or greater value, at its sole discretion. Sponsor is not responsible for lost, misplaced, or stolen Prizes.
8. GENERAL PRIZE CONDITIONS
By submitting an Entry, you warrant that all of the information provided as part of your Entry is accurate, does not violate any third party’s legal rights (including without limitation rights of privacy and publicity), and otherwise does not violate applicable law.
Each Winner shall be solely responsible for all federal, state, and local taxes, and the reporting consequences thereof. All other expenses associated with claiming the Prize, Prize acceptance, and Prize usage not specifically mentioned herein are the responsibility of the Winner.
A Potential Winner may be required to submit proof of age, an Affidavit of Eligibility, Liability Release, (where legal) Publicity Release, and/or a W-9 form for tax reporting purposes (collectively, the “Prize Claim Documents”) and return the Prize Claim Documents, properly executed, within the time period specified in the Notification before being eligible to receive the Prize. Upon Sponsor’s verification and receipt of the completed Prize Claim Documents, the Potential Winner will be deemed a Winner and Sponsor will arrange to award the Prize to the Winner.
In the event that: (a) a Potential Winner declines the Prize; (b) a Prize or Notification is returned as rejected, faulty, unclaimed, or undeliverable to such Potential Winner; (c) a Potential Winner cannot be reached, does not reply, or does not comply with the Notification instructions within the time period specified in the Notification; (d) a Potential Winner is not in compliance with these Official Rules; (e) a Potential Winner is found to be ineligible; (f) a Potential Winner refuses to sign or fails to return the fully completed and signed Prize Claim Documents to Sponsor within the time period specified in the Notification; (g) a Potential Winner submits falsified or fraudulent Prize Claim Documents; or (h) Sponsor is otherwise unable to notify a Potential Winner that they have been selected for any reason beyond the Sponsor’s control, then such person shall be disqualified, the Prize will be forfeited, and, at Sponsor’s sole discretion, an alternate Potential Winner will be selected by Sponsor at random from among all remaining eligible Entries received for the applicable Entry Period.
In the event that any error, mistake, failure, or discrepancy causes more than the stated number of Prizes as set forth in these Official Rules to be promoted, noticed, or claimed, Sponsor may award only the stated number of Prizes by having the Administrator conduct a random drawing from among all legitimate, unawarded, eligible Prize claims.
9. FORCE MAJEURE
In the event an insufficient number of eligible Entries are received and/or Sponsor is prevented from awarding the Prize(s) or continuing with the Sweepstakes as contemplated herein by any event beyond Sponsor’s control, including but not limited to fire, flood, earthquake, hurricane, tornado, explosion, Acts of God, acts of terrorism, war (declared or undeclared), riot or civil disturbances, work stoppages, labor disputes or strikes, communications or equipment failure, epidemic, pandemic or other issues concerning health or safety, state of emergency, utility or service interruptions, government regulation, natural disaster, any federal, state, local, or provincial government law, order, or regulation, order of any court or jurisdiction, or any other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), then Sponsor shall have the right to modify, suspend, or terminate the Sweepstakes or Prize(s). If the Sweepstakes is terminated before the designated end date of the Sweepstakes Period, Sponsor will (if possible and in its sole discretion) select the Potential Winner(s) in a random drawing from all eligible, non-suspect Entries received as of the date of the Force Majeure event giving rise to the termination. Inclusion in such drawing will be each Entrant’s sole and exclusive remedy under such circumstances.
10. PUBLICITY RELEASE
By accepting the Prize, each Winner grants to the Released Parties and those acting pursuant to the authority of the Released Parties (which grant will be confirmed in writing upon Sponsor’s request), the perpetual, irrevocable, worldwide, non-exclusive, royalty-free, sub-licensable, and transferable right to print, publish, broadcast, and use in all media, now or hereafter devised, without limitation at any time their full name, portrait, picture, image, voice, likeness, statements, identity, social media ID, Entry, state of residence, and/or biographical information (collectively, the Winner’s “Likeness”) for any and all purposes (whether commercial, non-commercial, or otherwise) including but not limited to on the Winner’s list for the Sweepstakes, without further compensation, consideration, notice to, or approval by Winner, to the extent permitted by applicable law in the Winner’s state of residence.
The foregoing license includes the right of the Released Parties to reproduce, display, distribute, publicly perform, create derivative works of, alter, amend, broadcast, edit, publish, use, merchandise, license, sublicense, and adapt the Winner’s Likeness, provided that Sponsor will not modify or edit Winner’s Likeness in a manner that is reasonably likely to be disparaging of the Winner. Accordingly, each Winner hereby waives any objection to such use including without limitation, distribution, reproduction, creation of derivative works of, public performance, or display of their Entry, and any claim for compensation whatsoever in connection therewith. Such waiver shall also include any claim for infringement of any so-called “Moral Right” or similar right or interest.
11. WAIVERS, DISCLAIMERS, AND RELEASES
By participating in this Sweepstakes, all Entrants agree to release, discharge, and hold harmless the Released Parties from and against any and all claims, liability, costs, losses, damages, or injuries of any kind arising out of or related to the Entrant’s participation in this Sweepstakes; or acceptance, possession, or use of the Prize, including without limitation, personal injuries, death, property damages, or data loss; or arising out of any violation of rights of publicity or privacy, or claims of defamation or portrayal in a false light; or based on any claim of infringement of intellectual property rights; or from any typographical, human, or other error in the printing, offering, selection, operation, or announcement of any Sweepstakes activity and/or the Prize.
Without limiting the generality of the foregoing, the Entrant agrees that the Released Parties: (a) have not made nor will be in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, in connection with this Sweepstakes and/or with respect to the Prize, including, without limitation, the Prize’s quality or fitness for a particular purpose (the Prize is awarded “as is”); and (b) will not be responsible or liable for any injury, damage, loss, expense, accident, delay, inconvenience, or other irregularity that may be caused or contributed to: (1) by the wrongful, negligent, or unauthorized act or omission on the part of any other person or entity not an employee of the Released Parties, and (2) by any cause, condition, or event whatsoever beyond the control of the Released Parties.
Released Parties are not responsible for: (i) any technical errors that may prevent an Entrant from submitting an Entry; (ii) unauthorized human intervention in the Sweepstakes; (iii) printing errors; (iv) errors in the administration of the Sweepstakes or the processing of Entries; (v) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, or destruction or unauthorized access to, or alteration of, Entries; (vi) any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers or providers, computer equipment, software, failure of any email or Entry to be received by Sponsor on account of technical problems, human error, or traffic congestion on the Internet or at any of the Websites, or any combination thereof, including any injury or damage to Entrant’s or any other person’s computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes.
Entrants further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorney fees. Entrants waive the right to claim any damages whatsoever, including but not limited to punitive, consequential, direct, or indirect damages.
For residents of New Jersey and any other jurisdiction where the foregoing limitations are prohibited by applicable law: the limitations set forth in this Section apply only to the extent permitted by the laws of your state of residence. Nothing herein is intended to bar recovery of damages or attorneys’ fees where such bar is prohibited by applicable statute.
EXCEPT AS EXPRESSLY PROVIDED ABOVE, IN NO EVENT WILL RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION IN THIS SWEEPSTAKES OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF A PRIZE.
12. GENERAL CONDITIONS
If the operation or administration of this Sweepstakes is impaired or incapable of running as planned for any reason, including but not limited to: (a) infection by computer virus, worms, bugs; (b) tampering or unauthorized intervention; (c) fraud; (d) technical failures; or (e) any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, then Sponsor reserves the right at its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes in whole or in part, at any time, without notice, and award the Prize(s) using all non-suspect eligible entries received as of, or after (if applicable) this cancellation, termination, modification, or suspension date, or in any manner that is fair and equitable and best conforms to the spirit of these Official Rules.
Sponsor reserves the right, at its sole discretion, to disqualify any Entrant or individual deemed to be tampering or attempting to tamper with the entry process or the operation of the Sweepstakes or the Websites; or acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY OF THE WEBSITES OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE; THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
13. GOVERNING LAW
All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules or the rights and obligations of Entrants, the Administrator, and the Sponsor in connection with the Sweepstakes shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s or jurisdiction’s laws.
By participating in the Sweepstakes, Entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes shall be resolved individually without resort to any form of class action; (b) any judicial proceeding shall take place in a federal or state court within the /Commonwealth of Virginia; (c) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event will attorney fees be awarded or recoverable; (d) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to seek, punitive, incidental, exemplary, consequential, special damages, lost profits, other damages, and/or any rights to have damages multiplied or otherwise increased; and (e) Entrant’s remedies are limited to a claim for money damages (if any) and he/she waives any right to seek injunctive or equitable relief.
14. ARBITRATION AND DISPUTE RESOLUTION
By participating in this Sweepstakes, each Entrant hereby agrees that any and all disputes, claims, causes of action, or controversies (“Claims”) arising out of or in connection with this Sweepstakes shall be resolved by arbitration pursuant to this provision and the code of procedures of the Commonwealth of Virginia.
IF ARBITRATION IS CHOSEN BY ANY PARTY WITH RESPECT TO A CLAIM, NEITHER PARTY WILL HAVE THE RIGHT TO LITIGATE THAT CLAIM IN COURT OR HAVE A JURY TRIAL ON THAT CLAIM. FURTHER, NEITHER SPONSOR NOR ENTRANT WILL HAVE THE RIGHT TO PARTICIPATE IN A REPRESENTATIVE CAPACITY ON BEHALF OF THE GENERAL PUBLIC OR OTHER PERSONS SIMILARLY SITUATED, OR AS A MEMBER OF ANY CLASS OF CLAIMANTS PERTAINING TO ANY CLAIM SUBJECT TO ARBITRATION. EXCEPT AS SET FORTH BELOW, THE ARBITRATOR’S DECISION WILL BE FINAL AND BINDING. NOTE THAT OTHER RIGHTS THAT ENTRANT WOULD HAVE IF ENTRANT WENT TO COURT ALSO MAY NOT BE AVAILABLE IN ARBITRATION.
ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES. ENTRANT HEREBY WAIVES ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ENTRANT, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON TORT, CONTRACT, NEGLIGENCE, OR OTHERWISE. The arbitrator’s authority to resolve Claims is limited to Claims between Sponsor and Entrant alone, and the arbitrator’s authority to make awards is limited to awards to Sponsor and Entrant alone. Furthermore, claims brought by either party against the other may not be joined or consolidated in arbitration with Claims brought by or against any third party, unless agreed to in writing by all parties. No arbitration award or decision will have any preclusive effect as to issues or claims in any dispute with anyone who is not a named party to the arbitration.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages; therefore, such exclusions may not apply to you. Notwithstanding any other provision in these Official Rules and without waiving either party’s right to appeal such decision, should any portion of this provision be deemed invalid or unenforceable, then the entire provision (other than this sentence) shall not apply.
15. CALIFORNIA CIVIL CODE § 1542 WAIVER
To the extent permissible under applicable law, by participating in this Sweepstakes, each Entrant expressly waives and relinquishes all rights and benefits afforded by California Civil Code § 1542 and any similar law of any state or territory of the USA. Section 1542 states as follows: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”
16. SEVERABILITY
The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. If any provision of the Official Rules is determined to be invalid, prohibited by law, or otherwise unenforceable, the other provisions will remain in effect and will be construed as if the invalid or unenforceable provision were not contained herein.
17. MISCELLANEOUS
These Official Rules contain the full and complete understanding with respect to the Sweepstakes and supersede all prior and contemporaneous agreements, representations, and understandings, whether oral or written, between Sponsor, the Administrator, and the Released Parties regarding this Sweepstakes. In the event of an inconsistency between these Official Rules and any disclosure or other statement contained in any Sweepstakes-related materials, including without limitation, an entry form or any point-of-sale, radio, television, print, or online advertising, these Official Rules will prevail and govern.
The headings herein are for convenience only, do not constitute a part of these Official Rules, and shall not be deemed to limit or affect any of the provisions hereof. No amendment to, or waiver of, any provision of these Official Rules shall be effective unless in writing and signed by Sponsor and the Administrator. The waiver by Sponsor or the Administrator of any provision of these Official Rules shall not constitute a waiver of any other provision herein.
The rights and obligations hereunder may not be assigned by Entrant, whether by operation of law or otherwise, without the prior written consent of Sponsor, and any attempted assignment in violation of the foregoing shall be null and void. These Official Rules shall be binding upon, and inure to the benefit of, the permitted successors and assigns of Sponsor, the Administrator, and Entrant.
When terms such as “may” are used in these Official Rules, the Sponsor has sole and absolute determination and discretion. By participating in the Sweepstakes, Entrant hereby agrees to waive any rights to claim ambiguity of the Official Rules. Sponsor reserves the right to change, alter, or amend these Official Rules as necessary, in its sole determination, to ensure the fair administration of the Sweepstakes or to comply with applicable law; provided, however, that no such amendment shall materially alter the eligibility requirements, Prize value, or odds of winning to the detriment of Entrants who have already submitted entries, unless required by applicable law or regulation. Sponsor reserves the right to change the duration of the Sweepstakes Period in its sole discretion and with or without notice. Any and all decisions of Sponsor regarding the Sweepstakes are final.
